Construction and demolition dust is one of the largest contributors to particulate pollution in Delhi NCR, and building sites are therefore among the most inspected places in the region. Under directions of the Commission for Air Quality Management, every construction or demolition site of 500 square metres or more in NCR must register on the relevant state's dust control portal, self-monitor and report its dust control measures, and follow a set of standard measures on screening, covering, wetting, transport and waste handling. In September 2026, the Commission extended this monitoring to sites beyond municipal limits. Larger sites must deploy anti-smog guns and, in many cases, dust sensors.
Construction waste itself is now regulated under the Environment (Construction and Demolition) Waste Management Rules, 2025, which came into force on 1 April 2026. They require producers of C&D waste to manage it through authorised channels, set rising targets for recycling of demolition waste and for using recycled C&D material in new construction and roads, and introduce EPR certificates and environmental compensation. This page explains both sets of rules, how they are enforced, and how builders and contractors can stay compliant.

Enforcement
Fines, environmental compensation, stop-work orders and GRAP bans.
The standard dust control measures
CAQM directions and state guidelines set out a standard list of dust control measures. Sites must have wind-breaking screens or barriers of adequate height around the boundary, cover stored construction material and debris, sprinkle water to suppress dust during excavation, cutting and loading, pave or regularly wet internal roads, wash vehicle wheels before they leave the site, and transport material and debris in covered vehicles. Cutting and grinding should be done with wet methods. Debris should not be left on roads or footpaths. Larger sites must operate anti-smog guns in numbers linked to the site area.
Inspection teams from boards, municipal bodies and development authorities check these measures visually and through photographs, and compare them with the self-monitoring reports on the portal. A site that reports full compliance on the portal but is found without screens or sprinkling faces a heavier penalty than one that reports honestly. Keep a site log with dated photographs of the measures in place.
The dust portal and self-monitoring
Each NCR state has a web portal for construction sites. Project proponents register the site with details of area, duration and dust control measures, and then report periodically through self-assessment, with photographs and, for larger sites, data from installed sensors and video monitoring as required. The portal allows authorities to identify sites, prioritise inspections and act against non-registered sites. Under the September 2026 revision of GRAP, the Commission extended the monitoring framework to sites beyond municipal limits, bringing peri-urban and rural sites in NCR within its scope, while keeping the 500 square metre threshold unchanged.
Non-registration is itself a violation and is easy for authorities to establish. If your site is 500 square metres or more and not registered, register immediately and start reporting. If your site is below the threshold, dust control measures still apply, even though portal registration does not.
The C&D Waste Management Rules, 2025
The Environment (Construction and Demolition) Waste Management Rules, 2025, published on 2 April 2025 and in force from 1 April 2026, replace the earlier C&D waste rules of 2016. They make producers of C&D waste, including builders, developers and those who commission demolition, responsible for managing all the waste their projects generate, including work done by contractors. Producers, recyclers, storage facilities and collection points must register on the CPCB portal.
The rules set targets. For demolition and reconstruction, producers must ensure recycling of a rising share of their waste, starting at 25 per cent of the previous year's waste in 2025-26 and rising to 100 per cent from 2028-29. For new construction, a rising share of recycled C&D material must be used, starting at 5 per cent in 2026-27 and rising to 25 per cent from 2030-31. Road construction has its own rising targets. Projects with a built-up area of 20,000 square metres or more, and road projects, must use processed C&D waste. Producers can meet obligations through EPR certificates issued to registered recyclers, valid for three years.
Waste management plans and local bodies
Under the 2025 rules, local and development authorities must approve a waste management plan as part of project approvals, monitor compliance, and report violations to the state board. They must also set up collection points and processing facilities, and support in-situ recycling. For builders, this means that building plan approval increasingly comes with conditions on C&D waste: how much will be generated, how it will be stored on site, which recycler will take it, and how much recycled material will be used.
Builders should prepare the waste management plan at the design stage, identify a registered recycler, and include recycled material in specifications where feasible, such as recycled aggregate in non-structural concrete, paver blocks and road sub-base. Contracts with contractors should allocate responsibility for waste handling and records, because the producer remains answerable to the authorities.
How to keep a site compliant
Register the site
On the state dust portal if 500 sq m or more, and on the CPCB C&D portal as a producer.
Install measures before work starts
Screens, covers, sprinklers, wheel wash and anti-smog guns as required.
Prepare the waste plan
Estimate C&D waste, identify recyclers and plan recycled material use.
Report honestly
Self-monitor on the portal with dated photographs.
Follow GRAP orders
Stop dust-generating work when a ban is in force.
Keep records
Waste handover receipts, recycler certificates and site logs.
Fines, compensation and stop-work orders
Authorities enforce dust norms through on-the-spot fines by municipal bodies, environmental compensation by boards and committees, stop-work orders, and, during GRAP, sealing of sites working in breach of bans. In Delhi, the DPCC has levied environmental compensation on construction sites for dust violations, based on the site area and the nature of the violation. Under the 2025 C&D rules, environmental compensation applies to producers who fail to meet their obligations, with partial refunds available if compliance is achieved within one to three years.
If your site is penalised, check the order carefully: the date and time of inspection, the alleged violation, the area used for calculating compensation, and whether you were given a hearing. Reply with photographs and site logs. Where the penalty is clearly excessive or based on wrong facts, an appeal or legal challenge may be appropriate. See environmental compensation demand.

How we work
We are a litigation and advisory practice led by Advocate BK Singh, with offices in Dwarka (New Delhi) and Vaishali (Ghaziabad). This is what you can expect:
- Registrations done right: dust portal and C&D portal.
- Site checks: before inspectors arrive.
- Waste plans and recycler contracts: under the 2025 rules.
- Penalties challenged: where facts or calculations are wrong.
- Written fee terms: agreed stage by stage, never linked to the outcome.
Mistakes we see on construction sites
- Starting excavation before screens and sprinklers are in place
- Reporting full compliance on the portal without evidence
- Dumping debris on roadsides or vacant plots
- Ignoring the 2025 C&D rules because the project started earlier
- Leaving waste handling entirely to contractors without records
A redevelopment in South Delhi
Here's a made-up example. A builder demolished an old bungalow in South Delhi to build a new residential block. The site was fined for debris left on the road and for missing screens.
We helped the builder register on the dust portal, install screens and a wheel wash, and contract with a registered C&D recycler for the demolition waste. The reply to the notice included photographs and the recycler agreement. The compensation was reduced after the authority accepted that the violation had lasted only two days.
A road contractor's recycled material
Here's a second made-up example. A road contractor in Haryana was asked by the authority to show how it would meet the recycled material requirement under the 2025 rules.
We reviewed the contract specifications and the rules, identified a registered recycler supplying processed aggregate for sub-base layers, and helped the contractor propose a material plan to the authority. The plan was accepted with conditions on testing.
