Kerala's environment is defined by its long coastline, backwaters, rivers, paddy fields and wetlands, and the Western Ghats along its eastern side. Land is scarce and densely used, so conflicts between development and the environment are frequent and often reach the High Court. The Supreme Court's 2019 order to demolish four apartment towers at Maradu in Kochi for CRZ violations, carried out in January 2020, is the best-known example. Floods in 2018, landslides including the 2024 disaster in Wayanad, and the 2023 fire at the Brahmapuram waste site in Kochi, after which the NGT imposed heavy compensation on the city corporation, have all shaped the debate.

Industries deal with the Kerala State Pollution Control Board. Conversion of paddy land and wetlands is governed by the Kerala Conservation of Paddy Land and Wetland Act, 2008. Cases go to the NGT's Southern Zone Bench in Chennai and the Kerala High Court in Kochi. We advise clients through online consultation, with local counsel on brief.

Coastal caution

CRZ after Maradu

The Maradu apartments had local building permits, but stood in a CRZ area where construction was not permitted. The Supreme Court ordered their demolition, and compensation for owners was pursued from builders and officials. The case made buyers, banks and local bodies far more cautious about coastal construction in Kerala. Projects near the sea, backwaters, estuaries and islands must check the approved coastal zone management plan, the no-development zone along tidal water bodies, and the island rules, and obtain CRZ clearance from the Kerala Coastal Zone Management Authority where needed. See CRZ clearance.

The 2008 Act

Paddy land and wetlands

The Kerala Conservation of Paddy Land and Wetland Act, 2008 prohibits conversion or reclamation of paddy land and wetland except as the Act allows, with local level committees and district authorities deciding on applications. Land recorded as paddy land in the data bank cannot be used for buildings without permission, and amendments have provided routes for regularising certain conversions on payment of a fee. Buyers of land in Kerala should check the land's status in the data bank and the revenue records before purchase, because unauthorised conversion can lead to restoration orders.

Hills and slopes

Quarries, landslides and the Ghats

Kerala's construction boom depends on granite quarries, many in the Western Ghats foothills. Quarries need mining permits, environmental clearance, consent and compliance with distance rules from habitations and other structures, which have been the subject of NGT and court decisions. After the 2018 floods and repeated landslides, quarrying and construction on steep slopes in districts such as Wayanad, Idukki and Malappuram have faced closer scrutiny. The Western Ghats eco-sensitive area proposals, sanctuary ESZs and forest laws restrict development in these areas. See eco-sensitive zones.

Industry and waste

The Eloor-Edayar industrial belt along the Periyar river near Kochi hosts chemical, fertiliser and metal units, and fish kills and discoloration of the river have led to board action and court proceedings. Units here must treat effluent, monitor discharges and maintain records. Urban waste is a major issue: the 2023 fire at the Brahmapuram waste site burned for days and led the NGT to impose substantial compensation on the Kochi corporation and direct improvements. Under the Solid Waste Management Rules, 2026, local bodies and bulk generators have clear duties. See bulk waste generator.

Our approach

How we work

We are a litigation and advisory practice led by Advocate BK Singh, with offices in Dwarka (New Delhi) and Vaishali (Ghaziabad). This is what you can expect:

  • Online consultation: quick review of your documents.
  • Land issues covered: CRZ, paddy land and slopes.
  • Buyer due diligence: before you invest in Kerala.
  • NGT Chennai matters: coordinated through our network.
  • Written fee terms: agreed stage by stage, never linked to the outcome.
Avoid these

Mistakes we see in Kerala

  • Relying on a local building permit without CRZ clearance
  • Buying land recorded as paddy land without checking
  • Quarrying without meeting distance rules
  • Building on steep slopes in landslide-prone areas
  • Filing NGT matters in Delhi instead of Chennai

A backwater resort plan

Here's a made-up example. An investor planned a resort on land beside the Vembanad backwaters, partly recorded as paddy land.

We checked the paddy data bank and the coastal zone management plan. The paddy portion could not be converted without permission, and part of the dry land was within the no-development zone. The investor redesigned the resort on the permissible area and applied for CRZ clearance.

Tourism and services

Hospitals, hotels and houseboats

Kerala's economy relies heavily on health care, tourism and services. Hospitals need biomedical waste authorisation and often consent; Kerala has a common biomedical waste treatment facility run under the Indian Medical Association, and hospitals must use authorised facilities. Hotels, resorts and houseboats on the backwaters need permits and must manage sewage and waste, as sewage from houseboats has polluted Vembanad and other backwaters. Ayurvedic resorts and homestays in the hills must comply with local building rules and waste management. See biomedical waste authorisation.

The high ranges

Plantations, wildlife and conflict

Tea, cardamom and rubber plantations in Idukki and Wayanad lie next to forests and wildlife sanctuaries, and human-wildlife conflict with elephants, tigers and wild boar has become a major public issue. The Western Ghats ESZ proposals and the Supreme Court's past directions on buffer zones around protected areas have caused concern among farming communities about restrictions on their land. Projects near sanctuaries must check ESZ notifications, and conversion of plantation land for other uses is restricted under the land reform laws. See eco-sensitive zones.

Quick checks

  • Is it within a CRZ no-development zone?
  • Is it on a steep slope in a landslide-prone area?
  • Is it near a sanctuary or in a proposed ESA village?
  • Does the project need a quarry or mining permit?
  • Which NGT bench and High Court will hear any dispute?
