Karnataka combines a technology and services economy centred on Bengaluru with manufacturing in the Bengaluru, Mysuru and Hosur corridors, iron ore and other mining in the north, a coastline around Mangaluru and Karwar, and a long stretch of the Western Ghats. Bengaluru's lakes, once the city's water system, have been damaged by sewage and encroachment, and the foaming and fires at Bellandur lake brought NGT intervention. Real estate projects face rules on lake buffers, STPs, tree felling and groundwater.

Industries and projects deal with the Karnataka State Pollution Control Board, the Karnataka Ground Water Authority under the Karnataka Ground Water (Regulation and Control of Development and Management) Act, 2011, and tree officers under the Karnataka Preservation of Trees Act, 1976. Cases go to the NGT's Southern Zone Bench in Chennai and the Karnataka High Court. We advise clients through online consultation, with local counsel on brief.

Real estate rules

Bengaluru lakes and buffers

Bengaluru's lakes and the stormwater drains, called rajakaluves, that connect them are protected by planning rules that set buffer zones in which construction is restricted. The NGT in 2016 ordered wider buffers around lakes and drains in the Bellandur wetland case, but the Supreme Court in 2019 set aside that direction and restored the buffers under the city's planning regulations. Projects near lakes and drains must therefore follow the zoning regulations and the revised master plan, and encroachment on lake beds or drains has led to demolition drives. Developers and buyers should check lake and drain buffers before building or buying.

A KSPCB focus

STPs and apartments

To reduce sewage reaching the lakes, the KSPCB requires apartment complexes above a size threshold to install and operate sewage treatment plants and reuse treated water, and has acted against complexes with non-functional STPs. Residents' associations inheriting STPs from builders often face notices for poor performance. Running the STP properly, testing treated water, and reusing it for flushing and gardening are expected. Builders handing over projects should ensure the STP is working and documented. See bulk waste generator for related waste duties.

State laws

Trees and groundwater

The Karnataka Preservation of Trees Act, 1976 requires permission from the tree officer to fell trees, with compensatory planting, and the felling of trees for road widening and metro projects in Bengaluru has been challenged in the High Court. The Karnataka Ground Water Act, 2011 regulates groundwater in notified areas, requiring registration of borewells and permission for new wells and commercial use, through the Karnataka Ground Water Authority. Many parts of Bengaluru are over-exploited, and tanker supply from borewells has been regulated. Projects should obtain both tree and groundwater permissions early. See tree felling permission.

Beyond Bengaluru

Western Ghats and mining

Karnataka's Western Ghats, including Kodagu, Chikkamagaluru, Shivamogga and Uttara Kannada, have forests, coffee estates, wildlife sanctuaries and tiger reserves such as Kali and Bhadra. The proposed Western Ghats eco-sensitive area notifications and sanctuary ESZs restrict mining, quarrying and some development. In north Karnataka, iron ore mining in Ballari, Chitradurga and Tumakuru was halted by the Supreme Court in 2011 after findings of large-scale illegal mining, and later resumed under caps and conditions monitored through the Court's Central Empowered Committee. Mining companies must keep production within approved limits. The coast around Mangaluru and Karwar has ports, refineries and CRZ issues.

Our approach

How we work

We are a litigation and advisory practice led by Advocate BK Singh, with offices in Dwarka (New Delhi) and Vaishali (Ghaziabad). This is what you can expect:

  • Online consultation: quick review of your documents.
  • Bengaluru issues covered: lakes, STPs, trees and groundwater.
  • Mining and Western Ghats: limits and approvals.
  • NGT Chennai matters: coordinated through our network.
  • Written fee terms: agreed stage by stage, never linked to the outcome.
Avoid these

Mistakes we see in Karnataka

  • Building within lake or drain buffers
  • Handing over apartments with non-functional STPs
  • Felling trees without tree officer permission
  • Drilling borewells without registration
  • Filing NGT matters in Delhi instead of Chennai
Illustration

An apartment STP notice

Here's a made-up example. A Bengaluru apartment association received a KSPCB notice because its STP's treated water exceeded the standards and was being let into a drain.

We advised engaging a qualified operator, repairing the aeration system, testing treated water monthly and reusing it for flushing and landscaping. The reply with the operator contract and fresh results satisfied the board.

Beyond Bengaluru city

Industrial corridors and electronics

Industrial areas around Bengaluru, such as Peenya, Bommasandra, Jigani, Doddaballapura and Hoskote, and corridors towards Tumakuru and Mysuru host electronics, automobile, aerospace, pharmaceutical and garment units. Peenya, one of Asia's largest industrial estates, has faced action over effluent and groundwater contamination. Units need consent, hazardous waste authorisation, EPR registrations for electronics and batteries, and groundwater permission. The garment industry around Bengaluru also faces buyer audits and wastewater issues from washing units. See e-waste EPR.

Mangaluru and Karwar

The coast and rivers

Coastal Karnataka has ports at Mangaluru and Karwar, refineries and petrochemical units, and the Kali and Netravati rivers. Projects in coastal areas need CRZ clearance, and estuaries and mangroves are protected. The Western Ghats rivers, such as the Kaveri and its tributaries in Kodagu, face pressures from sand mining, resorts and water diversion projects. Linear projects through the Ghats, such as railway lines and highways, have faced challenges over forest diversion and wildlife. See CRZ clearance.
