Goa is small but environmentally complex. Its coastline and estuaries are governed by the CRZ Notification and the state's coastal zone management plan, which decide what can be built near beaches, rivers and khazan lands. Its hinterland lies in the Western Ghats, with wildlife sanctuaries and forests, including private forests identified by expert committees. Iron ore mining was the state's largest industry until the Supreme Court in 2018, in the Goa Foundation case, quashed the second renewal of 88 mining leases, leading to a halt and later auctions of new leases. Tourism, real estate and second homes create constant pressure on land.

Units and projects deal with the Goa State Pollution Control Board for consents, the Goa Coastal Zone Management Authority for CRZ, the forest department for forests and trees, and the town and country planning department for land use. Cases go to the NGT's Western Zone Bench at Pune and the Bombay High Court at Goa. We advise clients through online consultation, with local counsel on brief.

Coastal rules in Goa

CRZ for villas, hotels and shacks

Much of Goa's tourism and real estate lies within or near the Coastal Regulation Zone. Construction in no-development zones along beaches and tidal rivers is largely prohibited, with exceptions for traditional dwellings and specified tourism facilities. Seasonal beach shacks are permitted under the state's shack policy and the CRZ rules, with conditions. The Goa Coastal Zone Management Authority has issued demolition orders against unauthorised structures, and the High Court has upheld many of them. Khazan lands, traditional reclaimed fields protected by sluice gates, have special ecological and legal significance.

Before buying or building near the coast or a river, check the approved coastal zone management plan, the high tide line demarcation, and any CRZ clearance for existing structures. See CRZ clearance.

Goa's special rules

Private forests and trees

Goa has identified private land with forest characteristics as private forest through expert committees, applying the broad meaning of forest from the Supreme Court's Godavarman judgment. Such land cannot be used for non-forest purposes without forest clearance. Disputes about whether a plot is private forest are frequent, and identification has been before the High Court. Separately, the Goa, Daman and Diu Preservation of Trees Act, 1984 requires permission from the Tree Officer to fell any tree, on any land, with compensatory planting. Felling without permission is an offence. Buyers should check private forest status and tree permissions before building. See tree felling permission.

A changed sector

Mining after the 2018 ruling

In Goa Foundation v Union of India (2018), the Supreme Court held that the state's second renewal of 88 mining leases was illegal and directed fresh grant of leases in accordance with law, halting most mining. Since then, the state has auctioned mineral blocks under the Mines and Minerals (Development and Regulation) Act. New lessees need fresh environmental clearance, forest clearance where applicable, consent from the board and compliance with the Supreme Court's earlier caps and conditions on mining in Goa. Dumps, transport through villages and impacts on water sources remain key issues.

The hinterland

Western Ghats and wildlife

Goa's eastern talukas lie in the Western Ghats, with the Mhadei, Netravali, Bhagwan Mahavir, Cotigao and Bondla wildlife sanctuaries and Mollem National Park. The Western Ghats eco-sensitive area notifications, sanctuary ESZs, and debates over a tiger reserve in the Mhadei area affect projects in these areas. Linear projects, such as highway widening, railway doubling and transmission lines through Mollem, have been challenged before the courts. Projects here need wildlife clearance and must follow ESZ restrictions. See eco-sensitive zones.

Avoid these

Mistakes we see in Goa

  • Buying a villa without checking its CRZ clearance
  • Ignoring private forest status of a plot
  • Felling trees without Tree Officer permission
  • Building permanent structures on beaches
  • Assuming old mining approvals still apply
Illustration

A second home near a river

Here's a made-up example. A Delhi family planned to buy a plot near a tidal river in north Goa.

We checked the coastal zone management plan and found that part of the plot was within the no-development zone along the river, and that it had several mature trees. The family bought the plot at a reduced price, designed the house outside the restricted part, and applied for tree permission only for one tree that had to be removed.

Planning in Goa

Hill cutting and conversion of land

Goa's town and country planning law controls conversion of land use, and the state's regional plan sets zones for settlement, orchards, forests, natural cover and eco-sensitive areas. Hill cutting and filling of low-lying fields without permission are prohibited, and the High Court has acted against unauthorised hill cutting and conversions, including for large projects. Changes to zoning through amendments to the regional plan have been challenged as harmful to the environment. Buyers and developers should check zoning, slope and conversion status before investing. See environmental due diligence.

Infrastructure gaps

Waste, sewage and tourism pressure

Goa's tourism season brings large numbers of visitors to coastal villages with limited sewage and waste infrastructure. Hotels, restaurants and shacks discharging sewage into rivers, fields and the sea face notices from the Goa board and the coastal authority. Under the Solid Waste Management Rules, 2026, larger hotels and resorts are bulk waste generators with duties to segregate, process wet waste and file returns. Casinos and vessels on the Mandovi need permissions and must manage waste. Planning sewage treatment and waste processing is essential for tourism businesses. See bulk waste generator.
