Maharashtra's environmental issues are shaped by its coast, its chemical clusters and its cities. In Mumbai and the surrounding region, the Coastal Regulation Zone and mangrove protection decide what can be built along the shore, creeks and wetlands, and the Bombay High Court has issued far-reaching orders protecting mangroves. The Maharashtra Industrial Development Corporation's estates at Taloja, Tarapur, Thane-Belapur, Mahad and elsewhere host chemical and pharmaceutical units that have faced NGT action for river and creek pollution. Around Pune, the automotive and engineering clusters of Chakan, Talegaon, Ranjangaon and Pimpri-Chinchwad, and the city's rapid growth, raise issues of effluent, groundwater, hill slopes, rivers and tree protection.
Units and projects deal with the Maharashtra Pollution Control Board for consents and enforcement, with the state coastal zone management authority for CRZ, with municipal tree authorities for felling, and with the NGT's Western Zone Bench, which sits in Pune. We serve Maharashtra clients through our associate office. This page sets out the issues we see most often.

CRZ and mangroves in Mumbai
Much of Mumbai's land lies close to the sea, creeks and wetlands, and the CRZ Notification, 2019 governs what can be built in these areas, through the approved coastal zone management plan for the region. Mangroves fall in CRZ-I and receive particular protection. In a 2018 judgment, the Bombay High Court directed that mangroves across Maharashtra be protected, prohibited their destruction, and required a buffer zone around them, and ordered that mangrove areas on government land be handed to the forest department. Destroying mangroves for construction, reclamation or dumping has led to criminal cases, restoration orders and demolition.
Projects near the coast or creeks should check the coastal zone management plan, the high tide line demarcation and any mangrove cover, including past cover shown in satellite images, before design. See CRZ clearance.
MIDC chemical clusters
Maharashtra's chemical estates, such as Taloja, Tarapur, Thane-Belapur and Mahad, have faced serious enforcement. The NGT has examined pollution of the creeks and rivers receiving effluent from these estates, found CETPs operating beyond capacity or below standards, and imposed environmental compensation on industries, CETP operators and authorities, with directions for upgrades and monitoring. Units in these estates must meet CETP inlet standards and allocations, avoid tanker dumping and illegal discharge, and maintain records.
When a unit in such an estate receives a notice, it should produce CETP records, flow data, test results and hazardous waste manifests, and respond to any compensation demand with a careful check of the basis. See environmental compensation demand.
Pune's industries and growth
Pune's automotive and engineering clusters at Chakan, Talegaon, Ranjangaon and Pimpri-Chinchwad generate effluent, paint sludge, used oil and other hazardous waste, and draw groundwater. The city's growth has pushed construction onto hill slopes and near rivers such as the Mula and Mutha, where development plans restrict construction on hill-top and hill-slope zones and in river flood lines. Riverfront development and tree felling for infrastructure projects have been challenged before the NGT and the High Court. Developers and buyers should check development plan zoning, flood lines and hill slope restrictions before building or buying.

Tree authorities and permissions
Maharashtra regulates trees in urban areas under the Maharashtra (Urban Areas) Protection and Preservation of Trees Act, 1975, under which municipal tree authorities grant permission to fell or transplant trees, with compensatory planting. Amendments in 2021 added protection for heritage trees, based on age, with stricter rules for felling them. Large infrastructure projects in Mumbai and Pune that require felling have been challenged by residents, and the Bombay High Court and the Supreme Court have supervised some of these cases. Developers should apply to the tree authority early, survey trees accurately, and plan for compensatory planting. See tree felling permission.

How we work
We are a litigation and advisory practice led by Advocate BK Singh, with offices in Dwarka (New Delhi) and Vaishali (Ghaziabad). This is what you can expect:
- Associate office in Maharashtra: local support.
- Coastal and mangrove advice: before design and purchase.
- MIDC cluster experience: CETPs and compensation.
- Pune bench and Bombay High Court matters: coordinated.
- Written fee terms: agreed stage by stage, never linked to the outcome.
Mistakes we see in Maharashtra
- Building near creeks without checking mangrove cover
- Tanker disposal of effluent from MIDC units
- Felling trees before tree authority permission
- Buying hill slope land without checking zoning
- Filing NGT appeals in Delhi instead of Pune
A Thane project near a creek
Here's a made-up example. A developer planned a residential project in Thane on land next to a creek. Old satellite images showed mangroves on part of the plot that had since been cleared.
We advised that the cleared area was likely to be treated as a mangrove area, with the buffer zone applying. The developer redesigned the project to keep the area and buffer free and applied for CRZ clearance on that basis.
A Taloja unit's compensation
Here's a second made-up example. A Taloja chemical unit received a compensation demand following NGT directions on creek pollution.
We reviewed the unit's CETP records and flow data, showing that it had stayed within its allocation and inlet standards. The demand was recalculated on the unit's actual contribution.
