Bihar's environmental issues are shaped by the Ganga and its tributaries, a dense population, a large brick kiln sector, extensive sand mining from rivers such as the Sone, and air pollution in Patna, Muzaffarpur, Gaya and other cities. Industry includes food processing, distilleries and ethanol plants, cement, and small manufacturing. Industries and establishments deal with the Bihar State Pollution Control Board for consents and enforcement.

Bihar adopted the Water (Prevention and Control of Pollution) Amendment Act, 2024 by resolution, so many Water Act contraventions are now dealt with by penalties imposed by adjudicating officers, rather than prosecution. Environmental cases from Bihar go to the NGT's Eastern Zone Bench in Kolkata, and High Court matters to the Patna High Court. We advise clients through online consultation, with local counsel on brief.

Cleaner technology

Brick kilns

Bihar has thousands of brick kilns, many of which used older, more polluting firing methods. The board and courts have required kilns to move to cleaner technology such as zig-zag firing, to hold consent, and to meet siting rules on distance from habitations, schools and water bodies. Kilns operating without consent or with old technology have been closed, and the NGT has dealt with kiln pollution in the state. Kiln owners should hold current consent, document their technology conversion, and use permitted fuels and soil sources, as excavation of soil can also need permission.

Sone, Ganga and tributaries

Sand mining

Sand mining from Bihar's rivers, especially the Sone, has been one of the state's most contested environmental issues, with concerns about illegal mining, overloaded trucks, and damage to river beds. Sand mining requires a lease or permit, environmental clearance under the framework for minor minerals, and compliance with the Sustainable Sand Mining Management Guidelines and the Enforcement and Monitoring Guidelines for Sand Mining. The state has periodically suspended mining during the monsoon and acted against illegal mining. Lease holders and transporters should keep EC, mining plans, transit passes and records.

Penalties, not prosecution

The Water Act amendment in Bihar

Because Bihar adopted the Water (Prevention and Control of Pollution) Amendment Act, 2024, contraventions such as operating without consent or violating conditions are dealt with by adjudicating officers who can impose penalties from Rs 10,000 up to Rs 15 lakh, with more for continuing contraventions. Appeals against penalty orders go to the NGT with a deposit of 10 per cent of the penalty. Units should reply to inquiry notices in time with evidence on the facts and the factors that affect the penalty. See environmental penalty defence.

Other issues

The Ganga and urban air

Industries and towns along the Ganga in Bihar must not discharge untreated effluent or sewage into the river, under directions linked to the National Mission for Clean Ganga. Distilleries and ethanol plants, which have expanded under the ethanol blending programme, generate spent wash and must achieve zero liquid discharge. Patna and other cities have struggled with air quality, especially in winter, with action plans under the national clean air programme targeting dust, vehicles, waste burning and brick kilns. Bihar has also banned certain plastic carry bags under its own notifications.

Our approach

How we work

We are a litigation and advisory practice led by Advocate BK Singh, with offices in Dwarka (New Delhi) and Vaishali (Ghaziabad). This is what you can expect:

  • Online consultation: quick review of your documents.
  • Kiln and sand experience: consents, EC and enforcement.
  • Penalty inquiries handled: under the amended Water Act.
  • NGT Kolkata matters: coordinated through our network.
  • Written fee terms: agreed stage by stage, never linked to the outcome.
Avoid these

Mistakes we see in Bihar

  • Running kilns without consent or with old technology
  • Mining or transporting sand without EC and transit passes
  • Ignoring adjudicating officer notices
  • Discharging spent wash from distilleries
  • Filing NGT matters in Delhi instead of Kolkata
Illustration

A brick kiln's conversion

Here's a made-up example. A brick kiln near Patna was ordered closed for using old firing technology without consent.

We advised converting to zig-zag firing, documenting the conversion and applying for consent with the siting details. The kiln reopened the next season with consent.

New industry

Ethanol plants and food processing

Bihar has encouraged investment in grain-based and molasses-based ethanol plants under the national ethanol blending programme and its own policies, along with food processing, maize and makhana processing units. Ethanol plants need environmental clearance, consent and groundwater permission, generate stillage and other wastes that must be managed to achieve zero liquid discharge, and use boilers with emissions. Communities near some plants have raised concerns about water use and odour. New units should plan water recycling and waste handling at the design stage and keep records from the start. See environmental clearance.

Water issues

Groundwater, arsenic and wetlands

Parts of the Ganga plain in Bihar have arsenic in groundwater, and drinking water schemes and industries drawing groundwater face scrutiny on water quality and safe sources. Wetlands such as Kanwar lake in Begusarai, a Ramsar site, have shrunk under agricultural pressure, and wetland rules restrict reclamation and dumping. The Kosi and Gandak floodplains have embankments and flood risks that affect where projects can be located. Projects near rivers should check flood zoning and wetland notifications. See groundwater NOC.

Quick checks

Questions before investing in Bihar

  • Does the unit need consent, and does it face Water Act penalties if late?
  • Does the project draw groundwater, and is the source safe?
  • Is the site near the Ganga, a wetland or a floodplain?
  • Do brick kilns or crushers supplying the project hold consent?
  • Is sand bought from licensed sources with transit passes?
  • Which NGT bench and High Court will hear any dispute?
