Chandigarh is a planned city and Union territory, the shared capital of Punjab and Haryana, with a small industrial area, a large services economy, and a strong planning framework from its original design. Its most prominent environmental issue is Sukhna lake, an artificial lake at the foot of the Shivaliks, and its catchment, which extends into Punjab and Haryana. The Punjab and Haryana High Court, in a 2020 judgment, declared the lake a legal entity, directed demolition of constructions in its catchment, and imposed costs, and that judgment has been the subject of appeals in the Supreme Court. The Sukhna Wildlife Sanctuary and its eco-sensitive zone add further restrictions.

Industries and establishments deal with the Chandigarh Pollution Control Committee. As a Union territory, Chandigarh is covered by the Water (Prevention and Control of Pollution) Amendment Act, 2024. Cases go to the NGT's Principal Bench in New Delhi and the Punjab and Haryana High Court in Chandigarh. We serve Chandigarh from our Delhi NCR offices, with appearance on brief.

Court orders

Sukhna lake and its catchment

Sukhna lake has suffered from silting and loss of water because of construction and erosion in its catchment, which includes parts of Punjab's Kansal and Haryana's Saketri villages. In 2020, the Punjab and Haryana High Court declared the lake a living entity, held constructions in the catchment area illegal, directed their demolition and imposed costs on the states. Appeals were filed in the Supreme Court, which has dealt with aspects of the matter. Owners and buyers of property in the catchment should check the current position of the orders and the catchment maps before buying, building or selling. See environmental due diligence.

Planning controls

The sanctuary ESZ and periphery

The Sukhna Wildlife Sanctuary, in the Shivalik foothills next to the lake, has an eco-sensitive zone notified around it, with the extent on the Chandigarh side and the neighbouring states' sides having been debated and fixed through separate notifications and court proceedings. The Supreme Court has also dealt with ESZs around protected areas generally. Around the city, the Punjab New Capital (Periphery) Control Act, 1952 restricts construction in the periphery to preserve the city's planning. Projects in these areas should check the ESZ, periphery and planning rules.

City planning

Trees and heritage

Chandigarh's green belts and avenue trees are part of its design. Felling trees needs permission from the forest and environment department of the Union territory, and courts have taken a strict view of unauthorised felling. The Capitol Complex, designed by Le Corbusier, is a UNESCO World Heritage Site, and construction in its buffer zone is controlled. Development projects in the city must also comply with the Chandigarh Master Plan and the heritage committee's decisions.

The industrial area

Industry and penalties

Chandigarh's industrial area hosts small and medium units in engineering, food, printing and other sectors. They need consent from the Chandigarh Pollution Control Committee and must manage effluent, emissions and waste. Because the Water (Prevention and Control of Pollution) Amendment Act, 2024 applies to Union territories, Water Act contraventions are dealt with by adjudicating officers through penalties from Rs 10,000 up to Rs 15 lakh. See environmental penalty defence. The Dadu Majra dumping ground has been a long-running waste issue for the city.

Our approach

How we work

We are a litigation and advisory practice led by Advocate BK Singh, with offices in Dwarka (New Delhi) and Vaishali (Ghaziabad). This is what you can expect:

  • Served from Delhi NCR: with appearance on brief.
  • Sukhna and ESZ issues: current orders and maps.
  • Penalty inquiries handled: under the amended Water Act.
  • High Court matters: in the Punjab and Haryana High Court.
  • Written fee terms: agreed stage by stage, never linked to the outcome.
Avoid these

Mistakes we see in Chandigarh

  • Buying property in the Sukhna catchment without checking orders
  • Building in the periphery without approval
  • Felling trees without permission
  • Ignoring adjudicating officer notices
  • Assuming ESZ limits are the same on all sides
Illustration

A house in the catchment

Here's a made-up example. A buyer was offered a house in a village in the Sukhna catchment at an attractive price.

We checked the catchment maps and the court orders, and found that the house fell within the area covered by the demolition directions under appeal. The buyer did not proceed.

Mohali and Panchkula

The tricity and shared issues

Chandigarh forms a tricity with Mohali in Punjab and Panchkula in Haryana, and many environmental issues cross the boundaries: the Sukhna catchment, the Shivalik foothills, the Ghaggar river, and air quality. Each part is governed by a different regulator: the Chandigarh Pollution Control Committee, the Punjab Pollution Control Board and the Haryana State Pollution Control Board. Projects near the boundaries should identify which authority has jurisdiction and whether the neighbouring state's rules, such as the Punjab Land Preservation Act in the foothills, apply. See Punjab and Haryana.

Urban waste

Waste and the Dadu Majra site

The Dadu Majra dumping ground, with a large legacy waste mound, has been a long-running source of complaints and litigation, and the NGT has directed bioremediation and closure of the site. Under the Solid Waste Management Rules, 2026, the municipal corporation and bulk generators have clear duties, and housing societies, hotels and institutions above the thresholds must segregate, process wet waste and file returns. See bulk waste generator.
