West Bengal stretches from the Darjeeling hills to the Sundarbans delta. Kolkata, one of India's oldest industrial cities, sits next to the East Kolkata Wetlands, a Ramsar site whose fisheries and farms treat much of the city's sewage naturally, protected by a state law of 2006. The Sundarbans, the world's largest mangrove forest, shared with Bangladesh, is a tiger reserve and World Heritage Site facing sea level rise and cyclones. The Asansol-Durgapur belt has coal mines, steel and power plants and has been identified as critically polluted, and the Raniganj coalfield has underground fires and subsidence.

Industries deal with the West Bengal Pollution Control Board. West Bengal adopted the Water (Prevention and Control of Pollution) Amendment Act, 2024, so many Water Act contraventions lead to penalties by adjudicating officers. The NGT's Eastern Zone Bench sits in Kolkata, and High Court matters go to the Calcutta High Court. We advise clients through online consultation, with local counsel on brief.

A special law

The East Kolkata Wetlands

The East Kolkata Wetlands cover about 12,500 hectares of sewage-fed fisheries, farmland and settlements on the city's eastern edge. The East Kolkata Wetlands (Conservation and Management) Act, 2006 created an authority to manage the area and prohibits change of land use within it without permission. Real estate expansion towards the eastern fringes has led to repeated litigation over illegal filling and construction, and the Calcutta High Court and the NGT have directed action against encroachments. Buyers and developers should check whether land falls within the wetland area before investing. See environmental due diligence.

Mangroves and CRZ

The Sundarbans and the coast

The Indian Sundarbans include a tiger reserve, national park and biosphere reserve, with islands protected by embankments that are vulnerable to cyclones. Construction, tourism and aquaculture in the area are regulated by CRZ rules, forest and wildlife laws and ESZ provisions. Destruction of mangroves for prawn farms or construction has led to action. Coastal projects at Digha, Haldia and Tajpur need CRZ clearance. See CRZ clearance.

Industrial belt

Asansol-Durgapur and Raniganj

The Asansol-Durgapur area has coal mines, steel plants, sponge iron units, power plants and cement, and has been identified as a critically polluted area. The Raniganj coalfield has underground fires and subsidence affecting settlements. Units need consent, must run emission controls continuously, manage fly ash and slag, and maintain online monitoring. The NGT has examined pollution and illegal mining in the area. See closure notice reply.

Urban issues

Kolkata's air and leather complex

Kolkata's air quality has been affected by old commercial vehicles, diesel buses, construction and industry, and the NGT has directed phasing out of older vehicles and other measures. Tanneries that once operated in east Kolkata's Tangra area were relocated under court orders to the Calcutta Leather Complex at Bantala, which has a common effluent treatment plant; units there must meet the CETP's inlet standards. Brick kilns in the surrounding districts need consent and cleaner technology.

Our approach

How we work

We are a litigation and advisory practice led by Advocate BK Singh, with offices in Dwarka (New Delhi) and Vaishali (Ghaziabad). This is what you can expect:

  • Online consultation: quick review of your documents.

  • Written fee terms: agreed stage by stage, never linked to the outcome.
Avoid these

Mistakes we see in West Bengal

  • Buying land in the East Kolkata Wetlands without checks
  • Clearing mangroves for prawn farms
  • Ignoring adjudicating officer notices
  • Running steel units without emission controls
  • Exceeding CETP inlet standards at Bantala

A warehouse near the wetlands

Here's a made-up example. A logistics company planned a warehouse on land near the Eastern Metropolitan Bypass.

We checked the wetland area maps and found that the plot fell within the protected East Kolkata Wetlands. The company did not proceed and found a site outside the area.

Port and petrochemicals

Haldia and the Hooghly

Haldia, at the mouth of the Hooghly, has a port, a refinery, a petrochemical complex and chemical units, and has been identified as a critically polluted area at times. The Hooghly receives industrial effluent and sewage from towns along both banks, including jute mills, chemical units and tanneries. Units in Haldia and along the Hooghly need consent, hazardous waste authorisation and CRZ clearance where in coastal or tidal areas. Petroleum refining and petrochemicals are covered by CCTS emission intensity targets. See carbon credits.

Hills, tea and forests

Darjeeling and the north

North Bengal's hills, around Darjeeling and Kalimpong, have tea gardens, forests and tourism, with landslide risks and construction on steep slopes. The Terai and Dooars have forests, elephant corridors and national parks such as Jaldapara and Gorumara, with railway lines through elephant habitats where collisions have killed elephants and speed limits and warning systems have been introduced. Projects in north Bengal should check slope, forest and corridor issues. The Calcutta High Court's Jalpaiguri bench hears matters from the north. See eco-sensitive zones.
