For a real estate project, environmental approvals sit on the critical path. A delay in environmental clearance or consent can hold up sanctions, funding and sales, and a violation found later can lead to stop-work orders, compensation and disputes with buyers.
We help developers get approvals in the right order and stay compliant through construction and handover, and we help buyers, RWAs and neighbours when environmental conditions are ignored.
Is this your situation?
- You are planning a housing, commercial or township project
- Your EC is pending, or you need to amend it for extra area
- A GRAP order or dust notice has stopped your site
- Trees on your plot need to be cut or transplanted
- Buyers or the RWA are complaining about environmental facilities
- You are buying land and want to check environmental restrictions
What we handle
Environmental clearance
Applications, amendments and extensions for building and township projects.
Board consents
Consent to establish and operate, and their renewals.
Trees and green area
Permissions and compliance with green area requirements.
Construction phase
Dust control, waste rules and GRAP compliance.
Handover
Transfer of STP, consents and records to the RWA.
Disputes
Board notices, NGT cases and buyer disputes.
The usual sequence of approvals
Every state differs a little, but the logic is the same: check land restrictions first, then apply for environmental clearance where needed, then consent to establish, then the other permissions before work starts. Consent to operate follows completion. Getting the order wrong is a common cause of delay.
| Stage | Typical approvals |
|---|---|
| Land check | Land use, distance from protected areas, wetlands, floodplains, forest status |
| Before construction | EC (if 20,000 sq m and above), consent to establish, groundwater NOC, tree felling permission |
| During construction | Dust and C&D waste compliance, GRAP in NCR, EC compliance reports |
| On completion | Consent to operate, STP commissioning, handover of records |
Restrictions that can affect a site
Some restrictions are easy to miss: eco-sensitive zones around protected areas, coastal regulation zones, notified wetlands, river floodplains, the Aravalli and Ridge areas in parts of NCR, and land recorded as forest. Each can limit or stop development. A short environmental land check before purchase avoids expensive surprises.

How we work
We are a litigation and advisory practice led by Advocate BK Singh, with offices in Dwarka (New Delhi) and Vaishali (Ghaziabad), working on environmental matters across India.
- Deadline first: we tell you the time limit before anything else.
- Regulator and tribunal: we handle the board stage and the NGT, so nothing is lost between them.
- Plain advice: what we think will happen, including when a case is not worth filing.
- Written fee terms: agreed stage by stage, never linked to the outcome.

Frequently Asked Questions
When does a building project need EC?
Under the EIA Notification, 2006, building and construction projects with a built-up area of 20,000 sq m or more need prior EC. Larger townships fall in a separate category.
Who grants EC for most building projects?
The State Environment Impact Assessment Authority (SEIAA) in most states.
Can GRAP stop my construction?
Yes. Under higher GRAP stages in Delhi NCR, construction and demolition can be restricted, with some exceptions.
Do we need a groundwater NOC for dewatering?
Usually yes, under the CGWA guidelines or the state groundwater law, depending on where the site is.
What must we hand over to the RWA?
At least the consents, EC compliance records, STP documents and maintenance records. Clear handover avoids later disputes.
Can we build near a river or lake?
Restrictions often apply to floodplains and around water bodies. Check the state rules and any court orders for the area.
